The Department of Home Affairs is in the final stages of preparing for the implementation of new changes in March 2018, with the exact implementation date impacted by legislative and systems release processes and timeframes.
This includes the implementation of:
- The new Temporary Skill Shortage visa (subclass 482) (referred to by the Department as the ‘TSS visa’)and
- Related changes to the Employer Nomination Scheme (ENS) (subclass 186) and the Regional Sponsored Migration Scheme (RSMS) (subclass 187) visa programs

Regional Sponsored Migration Scheme Visa
The Regional Sponsored Migration Scheme visa (subclass 187) is for skillful workers who aspire to work in regional Australia. The visa allows eligible Australian employers to sponsor suitably qualified overseas workers to live and work permanently in local areas of Australia.
This visa involves a three-step process. Firstly, approval from Regional Certifying Body (RCB), secondly, nomination by an approved Australian employer and then finally visa application under the nominated stream. If the visa application is done after receiving an approved nomination, the visa should be done within six months of the nomination being approved.
The visa is a permanent resident visa. You can reside in Australia or outside of the country when lodging visa application. It enables one to work in Australia under one of these three streams:
- The Temporary Residence Transition stream
- The Direct Entry stream
- The Labor Agreement stream.
Temporary Residence Transition Stream
The Temporary Residence Transition stream enables applicants who have had a Temporary Work (Skilled) visa Subclass 457. The nominating company will apply for Permanent Residence on behalf of the applicant.
Temporary Residence Transition Stream Eligibility
To be approved under the Temporary Residence Transition stream these are some of the eligibility requirements:
- The person must remain actively and lawfully operating
- The person must have satisfied the relevant training requirements
- The person must have no conflicting information about it
- The person must have met all obligations as a Subclass 457 approved sponsor
- The position must be the same (or closely related) position as was approved for the Subclass 457 visa
- The position should be an authentic position
- The position must be a full-time position available for a minimum of two (2) years from the time the visa is granted
- The position must meet the market salary rate and requirements
- The visa applicant must have had a Subclass 457 visa to work in the nominated (or closely related) position, with the nominating employer, for at least two years before the application
- The visa applicant must meet at least Vocational English skills
- The visa applicant must meet relevant health and character requirements
Direct Entry Stream
The Direct Entry stream permits applicants who do not meet the requirements of the Temporary Residence Transition stream to be nominated by an employer for Permanent Residence.
To be approved under the Direct Entry stream:
- The nominating employer must be actively and lawfully operating in Australia
- The nominating employer meet the relevant training requirements
- The nominating employer have no adverse information against it
- The nominated position continues to be an authentic position
- The nominated position must be a full-time position available for a minimum of two (2) years from the time the visa is granted
- The nominated position must meet the market salary rate and requirements
- The nominated position be listed for an occupation on the Consolidated Skilled Occupations List (CSOL)
- The nominated position must provide terms and conditions to Australian citizens and Permanent Residents
- The nominated person must be working in similar roles
- The visa applicant must be under 50 years old
- The visa applicant must have Competent English Skills
- The visa applicant must have a successful skills assessment for the nominated occupation (unless exempted)
- The visa applicant must have at least three (3) years of highly related work experience
- The visa applicant must meet relevant health and character requirements.
Labor Agreement Stream
The Labor Agreement stream is for applicants who are nominated by an employer who has entered into a Labor Agreement negotiated and agreed to be the Australian Government.
Applicants under this stream need to meet the age, skills and English language requirements provided under the relevant Agreement, in addition to proper health and character requirements.
